Wrong form of social distancing

I thought that I would see this kind of behavior only in sim. But, Cirrus passed under A320 right wing as if nothing happened. Shame there is ATC tape of a conversation with this airman. It is quite poor show of airmanship. Could this pilot loose a license? Or worse, could s/he face criminal charges - for endangering several people?
